DOES ANYONE HAVE A PROBLEM WITH THIS?
Posted by Chris
Okay, let me start by saying, this
eBay
seller really isn’t doing anything wrong. He is describing his item as a reproduction signed Babe Ruth baseball.
Usually when I see something of this nature it is poorly done and not a whole lot to worry about, because a poorly done Ruth is probably not going to fool anyone anyway. That said, this repro was done rather well and could definitely fool a potential buyer if it was described fraudulently.
Now, like I said, the seller has disclosed that this ball is a reproduction, but will the next guy who sells this describe it that honestly? I think we all know what the answer might be and that potential crooked activity may cause someone a loss of thousands of dollars.
Should eBay pull this auction? I almost think they should, but will they? We will see.

Chris,
Looks like somebody forked over the $150 to purchase this. I have to agree with you on your point. The buyer most likely didn't purchase this ball for his personal collection. Keep your eyes open down the road, as this ball looks to good to stay under the radar for long.
I bet GAI would pass it for $100!! Any new news with them?

Last thing I heard on GAI is that they are up and running again. I haven't heard if they are getting many submissions or not. The news on GAI has been very quiet the last couple weeks or so.

Even though this is listed correctly, you want eBay to pull the auction because of what someon MIGHT do with it down the road? That's ridiculous.
What about cards that have rough corners and edges . . . if the seller describes it that way, do you want eBay to pull that auction too because someone else may trim the card and sell it as Mint condition? Or they'll resell it as having great corners/edges?
Come on guys... do we really want this kind of oversight on the potential uses of something?

JRJ,
Ridiculous or not, technically, I don't think this seller has the right to produce items while using Ruth's likeness anyway. So, yes... I think they should pull the item.
Legally, I don't think you can create a product of a former player and then sell it without paying his agency or family. There are licensing issues you are forgetting about.

Chris - Great blog and most of us wouldn't do anything like this because of our passion for the hobby, but you're confusing morals with legal issues.
Think about all the custom McFarlane-esque action figures people create? Example: We've all seen the Emmitt Smith McFarlane-esque in a Florida Gators uniform. The guy who creates them is upfront and says it is home-made... he's an artist. Should eBay pull that too because someone may buy it and then sell it later as an actual McFarlane sports figure?
I think we have a passion for baseball, the babe, and our hobby; but we shouldn't let that get in the way of more eBay oversight to the point where we need a receipt to prove we can sell something on their online garage sale.
Great blog - great topic - thanks for the discussion.

JRJ,
I just would hate to see someone buy that Ruth ball down the road for thousands of dollars. It is a good fake and could fool people.
This is a way different subject than those fantasy McFarlane pieces.
My only point about the licensing issue is that I agree with you that eBay would never pull the item, just like when you said they wouldnt pull a card that had rolled corners or a fixed crease, but if there was a legal way to pull it then more power to them and I would hope it would be pulled.
Thank you too for the discussion and it is a good debate!
